1. Acceptance of Terms

By installing or using Aube AI ("the Service"), you ("Merchant") agree to these Terms of Service. If you do not agree, do not install or use the Service.

2. Description of Service

Aube AI provides an AI-powered customer support widget for Shopify stores. The Service enables automated responses to customer inquiries about orders, products, and store policies, as well as human handoff and analytics features.

3. Eligibility

You must have an active Shopify store and be the store owner or an authorized administrator to install and use the Service.

4. Subscription and Billing

  • The Service is available on Free, Starter ($39/mo), Growth ($99/mo), and Pro ($249/mo) plans
  • Paid plans are billed monthly in advance via Stripe
  • A 14-day free trial is available on all paid plans; no credit card required during trial
  • You may cancel at any time; access continues until the end of the current billing period
  • We reserve the right to change pricing with 30 days' notice to active subscribers

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Transmit false, misleading, or deceptive content to customers
  • Reverse-engineer or attempt to extract our AI models or proprietary systems
  • Resell or sublicense the Service without written permission

6. AI-Generated Responses

The Service uses AI to generate responses based on your store data. AI responses may occasionally be inaccurate. You are responsible for reviewing and configuring the AI's knowledge base and for the customer experience on your store. Aube AI is not liable for decisions made by customers based on AI-generated content.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

8. Intellectual Property

All rights, title, and interest in the Service, including software, design, and AI models, remain with Aube AI. You retain ownership of your store data. You grant Aube AI a limited license to process your store data solely to deliver the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Aube AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount paid by you to Aube AI in the three months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements.

11. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your data will be deleted within 30 days per our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
